1) Agreement to These Terms
These Terms of Service (“Terms”) govern your access to and use of the Prime Doctor RX website, patient portal, communications, and telehealth services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.
2) Eligibility and Location
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. You represent that you are physically located in a state where Prime Doctor RX and its affiliated licensed clinicians are authorized to provide care at the time services are rendered.
3) No Guarantee of Treatment
All clinical services are provided only when deemed clinically appropriate by a licensed clinician. There is no guarantee that treatment, prescriptions, or medications will be recommended or provided.
4) Telehealth Services
Services are provided via telehealth. By using the Services, you consent to receive healthcare remotely and acknowledge that telehealth has limitations compared to in-person care.
5) User Responsibilities
- Provide accurate, current, and complete information
- Maintain the confidentiality of your login credentials
- Use the Services only for lawful and appropriate purposes
- Not misrepresent identity or medical information
6) Fees and Payments
You agree to pay all fees disclosed at checkout or within your selected plan. Certain services may be offered on a recurring billing cycle. Fees are not contingent upon receiving a prescription or treatment recommendation.
7) Labs and Prescriptions
Laboratory testing may be required prior to and during treatment. If medication is prescribed, fulfillment is handled by licensed pharmacies. Shipping times may vary and are not guaranteed.
8) Prohibited Use
- Attempting to obtain prescriptions fraudulently
- Providing false or misleading information
- Harassing or threatening staff or clinicians
- Interfering with platform security or operations
9) Intellectual Property
All content, trademarks, and branding are the property of Prime Doctor RX or its licensors and may not be used without prior written permission.
10) Limitation of Liability
To the fullest extent permitted by law, Prime Doctor RX shall not be liable for indirect, incidental, consequential, or punitive damages. Total liability for any claim shall not exceed the amount you paid to Prime Doctor RX for Services during the twelve (12) months preceding the claim.
11) Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
12) Changes to These Terms
We may update these Terms from time to time. Continued use of the Services after changes constitutes acceptance of the updated Terms.
